Combined Sewer Overflows--Guidance For Financial Capability Assessment And Schedule Development, Final.
This document provides guidance on implementing EPA's National Combined Sewer Overflow (CSO) Control Strategy, issued on August 10, 1989 (54 FR 37370) and CSO Control Policy (April 19, 1994, 59 FR 18688). The CSO Strategy reaffirmed that CSOs are point source discharges subject to the NPDES permit requirements and Clean Water Act requirements. The CSO Policy allows for an implementation schedule that "may be phased based on the relative importance of adverse impacts upon water quality standards and designated uses, priority project identified in the long-term plan, and on a permittee's financial capability."
This document provides guidance on how to assess permittees' financial capability and appropriately use that information to develop a CSO control strategy. The document has two goals. The first goal is to provide a planning tool for evaluating the financial resources a permittee has available to implement CSO controls. The second goal is to assist the permittee, EPA, and state NPDES authorities in cooperatively developing CSO control implementation schedules.
