EPA is proposing regulations implementing section 316(b) of the Clean Water Act. The Proposed Section 316(b) Rule for Phase III facilities would establish national performance requirements for the location, design, construction, and capacity of cooling water structures (CWIS) at facilities subject to this regulation. Facilities potentially subject to regulation under Phase III consist of the following types of facilities that employ CWIS and are designed to withdraw two million gallons per day or more from waters of the United States: (1) existing manufacturing facilities (2) existing electric power producing facilities with a design intake flow (DIF) of less than 500 million gallons per day (MGD), and (3) new offshore oil and gas extraction facilities.
