Before November of 1986, EPA is required, under the Hazardous and Solid Waste Amendments of 1984 (HSWA), to promulgate a schedule and methodology for assessing the safety of land disposal of hazardous waste. if land disposal of a waste is found to endanger human health and the environment, EPA will ban that waste from land disposal. Generators whose wastes are banned are also permitted, under the HSWA, to petition for a variance from the ban, where "it has been demonstrated to the Administrator, to a reasonable degree of certainty, that there will be no migration of hazardous constituents from the disposal unit or injection zone for as long as the wastes remain hazardous."
