Through the Noise Control Act of 1972 (86 Stat. 1234), Congress established a national policy "to promote an environment for all Americans free from noise that jeopardizes their health and welfare." Section 6 of the Act requires the Administrator to publish proposed regulations for each product identified as a major source of noise and for which in his judgment noise standards are feasible. Such products fall into various categories, of which construction equipment is one. Pursuant to Subsection 5(b)(1), the Administrator has published a report identifying portable air compressors as a major source of noise.
